HS Code (Customs Code / Tariff Classification): What It's For and How to Determine It Correctly

To properly clear a shipment through customs, you first need to identify its HS code, as it's the cornerstone of every customs declaration.

What is the HS code?

The HS code (Harmonized System), also called the SH code or tariff nomenclature, is an international classification system established by the World Customs Organization. It consists of a common 6-digit base used by over 200 countries, often extended to 8 digits (European Combined Nomenclature) or 10 digits depending on national requirements. Each code precisely identifies the nature of an imported or exported product — whether furniture, technical equipment, or construction materials.

Why is this code so important?

The HS code directly determines the customs duty rate applicable to the goods. It also governs any restrictions, authorizations, or certifications required, particularly for regulated products or those subject to specific technical standards. It also serves as the basis for official foreign trade statistics, which customs authorities use to guide their inspections.

The risks of misclassification

An incorrect HS code can lead to improper taxation, creating a risk of retroactive tax reassessment. Financial penalties may also apply, and the goods can even be held at customs until the classification is clarified. This risk is especially high for technical or hybrid products, whose category isn't always obvious.

Where and how to declare the HS code

The HS code must appear on both the commercial invoice and the customs declaration. If there's any doubt about a product's classification, importers can request a Binding Tariff Information (BTI) ruling from French customs. This official document legally secures the chosen classification, protecting the importer in case of an inspection.

Getting the classification right from the start

Ultimately, for a business that imports regularly, having a sourcing bureau or customs specialist verify the HS code of its products before the first shipment helps avoid future disputes with customs authorities. That said, this upfront check doesn't remove the need for ongoing vigilance, since product ranges evolve and the tariff nomenclature itself is regularly updated.
